1. Acceptance of these terms

These Terms and Conditions ("Terms") govern your use of ALENA HUB, the website at alena.cc, its Discord bot and any related services (together, the "Service"). The Service is run privately by its operators, Alena and Panther ("we", "us", "the operators").

By requesting an account, signing in, connecting an app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. No affiliation

ALENA HUB is an unofficial, independent project created by its operators. It is not affiliated with, connected to, endorsed by or sponsored by:

• PolygonX or its developers;
• Niantic, the developer of Pokémon GO;
• Nintendo, Creatures Inc., GAME FREAK inc. or The Pokémon Company;
• Discord, or any other company whose products or services are mentioned on the Service.

None of these companies are responsible for the Service, and none of them provide support for it. Please do not contact them about ALENA HUB.

3. The service

ALENA HUB is a private, non-commercial tool that records and displays statistics about your Pokémon GO accounts, such as catches, encounters, sessions, Pokédex progress, storage, medals and items. Data reaches the Service through a third-party app that you choose to configure yourself.

The Service is read-only with respect to your game: it never logs in to, controls or changes your game account. It is provided free of charge, as a hobby project, with no guarantee of continued operation.

4. Accounts and approval

• Accounts are created on request and must be approved by an administrator before they can be used. Approval is entirely at our discretion and may be refused or withdrawn without explanation.
• You must provide accurate information, including a Discord username we can use to contact you.
• You are responsible for keeping your password and your personal app address secret. Anyone with your app address can send data to your account. If you think either has been exposed, change your password and create a new app address straight away.
• Accounts are personal. Do not share, sell or transfer your account.
• We may change access levels, rename profiles, merge or separate game accounts, or link historical ("legacy") data to your account where this is needed to run the Service.

5. Data we collect

To provide the Service we store:

• Account details: your username, a securely hashed password, your Discord username and ID, your settings and the time of your last sign-in.
• Game data sent by the app you configure: in-game names, trainer statistics, catches, hatches, encounters and their outcomes, Pokémon details (species, form, IVs, CP, level, size, background), Pokédex entries, Pokémon storage, items, medals, play sessions and activity times.
• Location data attached to encounters and catches, such as spawn points, PokéStops, gyms or your approximate position at the time.
• Technical data needed to keep the Service secure and working, such as error logs and sign-in attempts.

Location data can reveal where you play. Only connect the app if you are comfortable with this information being stored.

6. How data is used and shared

• Your data is used only to run, secure and improve the Service and to show you your own statistics.
• Your data is visible to you and to the operators. Administrators can view and manage all accounts and data in order to run the Service.
• If you join the leaderboard, your account name, team, level and selected statistics are shown to other users. You can hide your in-game names or leave the leaderboard at any time.
• Public feed posts in Discord (for example shiny or hundo alerts) are only made if you turn them on.
• We do not sell your data, use it for advertising, or share it with third parties, except where required by law.

7. Retention, inactivity and deletion

• We keep data for as long as your account exists, unless we decide to remove it sooner.
• Accounts and profiles that have been inactive for an extended period may be suspended or deleted, together with their data, without notice.
• We may delete, trim or archive any data at any time, for example to save storage space, fix errors or maintain the Service.
• You may ask for your account and data to be deleted by contacting us. Some data may remain in backups or logs for a limited time.
• We do not guarantee that data is kept, backed up or recoverable. Keep your own copies of anything important to you.

8. Acceptable use

You agree not to:

• attempt to access accounts, profiles or data that are not yours, or to bypass approval, access levels or other restrictions;
• send false, manipulated or excessive data, or interfere with, overload or disrupt the Service, its servers or the Discord bot;
• scrape, copy or redistribute other users' data;
• use the Service for anything unlawful, abusive or harmful;
• impersonate another person, or use a username that is offensive or misleading.

We may remove content, rename accounts or restrict access if we believe these rules have been broken.

9. Third-party games, apps and services

• The Service relies on third-party apps, such as PolygonX, that you install and configure yourself. We do not make, distribute or support those apps and have no affiliation with their developers.
• Your use of those apps, and of Pokémon GO, is governed by their own terms. You are solely responsible for any consequences of using them, including any action taken against your game account.
• Pokémon images, sprites, medal and item artwork are loaded from public third-party sources and remain the property of their respective owners.

10. Ownership and intellectual property

• The Service, including its design, code, layout, text, features, databases and compiled statistics, is owned by the operators. All rights are reserved.
• You may not copy, modify, distribute, sell, or create derivative works from the Service or any part of it without our written permission.
• You keep any rights you have in the game data you send. By sending it, you give us a non-exclusive, royalty-free licence to store, process, display and use it to provide and improve the Service, including in aggregated or anonymised form.
• Pokémon, Pokémon GO and all related names, characters and marks are trademarks of their respective owners and are used here for identification only.

11. Availability and changes to the service

We may change, add or remove features, limit access, or suspend or permanently shut down the Service, in whole or in part, at any time and without notice. We aim to keep the Service running but do not promise any level of availability.

12. No warranty

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that statistics, rates, maps or other information shown are complete, accurate or up to date, or that the Service will be secure, uninterrupted or error-free.

13. Limitation of liability

To the fullest extent permitted by law, the operators are not liable for any loss or damage arising from your use of, or inability to use, the Service. This includes the loss of data, the loss of or restrictions on game accounts, and any indirect or consequential loss. Nothing in these Terms limits liability that cannot be limited by law.

14. Suspension and termination

We may suspend, restrict or delete your account, profiles or data at any time and for any reason, including inactivity, breach of these Terms, or the closure of the Service. You may stop using the Service at any time and ask us to delete your account.

15. Changes to these terms

We may update these Terms from time to time. The date at the top of this page shows when they last changed. Continuing to use the Service after a change means you accept the updated Terms.
